Class action lawsuit against Apple for defects on the screens of the iPhone 6 and 6 Plus
Some users in the United States have filed a class action lawsuit against Apple, because the defect is “latent” who is hitting the display and the touch screen of several iPhone 6 and iPhone 6 Plus.
The class action was filed today in U.s. District Court in Northern California: in the lawsuit, Apple is accused of violating the statute, consumer fraud, negligent misrepresentation, and breach of the implied warranty. According to the plaintiffs, Apple was aware of the problem but has done nothing to inform users in time, so as to make the terms of the legal warranty. Now, users are forced to pay for the assistance official (or third party) in order to replace the iPhone whose defects are attributable solely to Apple.
With the class action, active, american users can request damages to Apple. Will be the judge to determine if there are the conditions to continue with the survey.
Remember that this is a problem of manufacture of the latent that affects a significant number of devices, and that is manifesting itself after months and months of use of the device. This is a problem that affects mainly the iPhone 6 and 6 Plus sold in the first months availability: in addition to the gray bar, the display is also less responsive to touch (in the worst cases, the touch screen is not responding at all).
At the moment, Apple does not recognize it as a problem of the factory and therefore can not be request a warranty repair if you are past the legal terms of the same. Among other things, the replacement of the display does not solve the problem, which is caused by the controller chip to the touch screen soldered on the logic board of the phone. In practice, in the iPhone “defective”, just a few small impact during normal use to blow up the welding and to lose contact between the controller chip and the logic board.
According to iFixit, the only way to solve the problem is to replace the iPhone, the logic board or the integrated circuits on the same (these last two procedures are not carried out by Apple). For those who have an iPhone 6/6 Plus warranty, to the minimum problem (touch screen starts to show the first signs of a slowdown or malfunction), the advice is to immediately request the replacement from Apple; however, if the phone is already out of warranty, my suggestion is to go to a technical expert for the replacement of the chip. The hope is that Apple can, however, recognise the problem and make the replacement under warranty.
